Terms of Service

By downloading, installing, or using the Turn & Play application, pedal firmware, or website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. License Grant

Turn & Play grants you a limited, non-exclusive, non-transferable, revocable license to use the mobile application for personal, non-commercial, or professional musical performance purposes on devices you own or control.

2. The Bluetooth Foot Pedal

The Turn & Play Bluetooth foot pedal is proprietary hardware designed and supplied by Turn & Play. Firmware updates are delivered wirelessly through the application. You may not reverse-engineer, copy, or reproduce the pedal hardware, its firmware, or its internal design, and you may not market any device as an official "Turn & Play" product without prior written consent.

3. Intellectual Property

The "Turn & Play" name, brand assets, app interface designs, styling, logo designs, and application source code are the intellectual property of Turn & Play and are protected by copyright laws. You may not copy, reverse-engineer, or re-distribute the proprietary compiled mobile application.

4. User Content

You retain full ownership and copyright of any PDF scores, setlists, and drawings you import or create within the application. Because all files are stored locally on your device, we are not responsible for any loss of data, document corruption, or device failures. We highly recommend maintaining your own backups.

5. Premium Purchases

Turn & Play offers a free tier with limitations, and a paid premium unlock. Transactions are processed through Google Play and Apple App Store. All refunds, billing inquiries, and subscription management must be handled directly through your respective app store account.

6. Disclaimer of Warranties

THE APPLICATION AND HARDWARE SPECIFICATIONS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE OPERATION OF THE DEVICE OR APP WILL BE UNINTERRUPTED OR COMPLETELY ERROR-FREE DURING PERFORMANCE GIGS. USE OF THE PEDAL DURING LIVE STAGE PERFORMANCE IS AT YOUR OWN DISCRETION AND RISK.

7. Limitation of Liability

IN NO EVENT SHALL TURN & PLAY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE APPLICATION OR PEDAL, INCLUDING STAGE PERFORMANCE DISRUPTIONS OR GIG LOSSES.

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction where the project owner resides.
